About these terms
What these terms cover. These are the terms of service which apply to your use of our online Plane & Simple marketplace, through which we facilitate your purchase of goods from sellers. You may purchase goods from sellers via our online marketplace either by using our website or app (to the extent our app is available).
Why you should read them. Please read these terms carefully before you use our online Plane & Simple marketplace and/or purchase goods from sellers via our marketplace. These terms tell you who we are, what we do, how we facilitate your purchase of goods and how your orders will be processed, and other important information. If you think that there is a mistake in these terms, please contact us to discuss.
Revision of these terms. Please note that we may revise these terms of service from time to time. Every time you wish to use our marketplace, please check these terms to ensure you understand the terms that apply at that time. These terms were most recently updated on 11 February 2021.
Information about us and how to contact us
Who we are. We are It’s Plane & Simple Ltd, a company registered in Scotland. Our company registration number is SC677840 and our registered office is at Donaldson House Saltire Centre, Pentland Park, Glenrothes, Scotland, KY6 2AG. We trade as Plane & Simple and when we refer to this trading name or “we”, “us” or “our” in these terms, we are referring to It’s Plane & Simple Ltd.
How to contact us. For enquiries about your order, you should contact the seller from whom you ordered goods via our online Plane & Simple marketplace, their contact information will be provided in the order confirmation communication and your order history in your Plane & Simple account. For all other matters you can contact us by writing to us at email@example.com.
How we may contact you. If we have to contact you we will do so by telephone or email using the details that you provided to us in your order or account details.
Your account details
If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.
If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at firstname.lastname@example.org.
Important legal notice: Plane & Simple is an online marketplace on which you can purchase construction materials and home improvement related goods directly from trade sellers. When you place an order, you are purchasing the relevant goods directly from the applicable seller and not from Plane & Simple. As such, your contract in respect of the purchase of goods via our online marketplace is between you and the seller of the relevant goods.
Please read these terms of service very carefully, together with any terms and conditions provided by the relevant seller. By ordering via Plane & Simple, you are indicating that you understand and agree to these terms.
How your order will be processed. When you place an order to purchase goods from sellers via the Plane & Simple marketplace, you enter into a contract with the relevant seller on our marketplace. Your order will be sent to the relevant seller on our marketplace who will fulfil it or communicate any changes to you using the contact details you provided in your order.
If the seller cannot accept or fulfil your order. Please note that if the seller has accepted your order, they may have the right to bring their contract with you to an end. This could be because the relevant goods are out of stock, because they have identified an error in the price or description of the product, or for any other reason. If the seller is unable to process your order or subsequently brings their contract with you to an end, we will let you know (to the extent the seller informs us of this) or the seller will inform you of this directly. The seller’s terms governing the delivery and returns of your purchase of goods from the seller shall be available to you in your order confirmation and in your order history in your Plane & Simple account, we would advise you to read these terms carefully.
If you are not entitled to place orders via Plane & Simple. A seller may inform us that they are unable to accept orders from you, in which case we will notify you of this and will request that you do not attempt to place orders with any seller via Plane & Simple. If you continue to place orders, then we will decline or subsequently cancel your order and we may charge you an administrative fee to cover our costs in doing so. If the goods are out of stock. If the seller is unable to fulfil your order because one or more goods are out of stock, then unless the seller has advised otherwise, the seller may offer you alternative goods for the same price as your original order (or depending on the circumstances and seller, we may contact you on their behalf). The terms provided to you by the seller should set out your rights in respect of the goods you have ordered in more detail.
Disclaimer: By ordering via the Plane & Simple online marketplace, you acknowledge that the legal contract for your purchase is between you and the seller. Plane & Simple is not a party to any such contract. As the provider of the Plane & Simple online marketplace, Plane & Simple's role is solely to facilitate orders between sellers and buyers through the online marketplace. In particular you accept that:
If you want to cancel or make a change to your order. If you wish to cancel or make a change to your order, please contact the seller from whom you ordered. The seller will let you know if your request is possible. If a change you have requested is possible the seller will let you know about any changes to the price, delivery timing and anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change. Please note that it is not possible to cancel or make any changes to your order once your goods are out for delivery.
Mediation with sellers: We are under no obligation to mediate disputes that may arise between you and a seller on the Plane & Simple online marketplace. However, where resolution to a matter is not reached between you and a seller, we may at our discretion attempt to help resolve any problems if we believe that it would be reasonable to do so in the circumstances.
Delivery of your order
How and when the seller will deliver to you. Every seller on the Plane & Simple marketplace sets its own delivery policy, links to delivery policies will be available on the product pages and in your order history in your Plane & Simple account. Each seller on the Plane & Simple marketplace must deliver goods in accordance with their delivery policy and will contact you to confirm delivery plans. Delivery lead times shown on our website are estimates only.
Sellers only deliver to certain postcodes. Our marketplace solely facilitates the sale of goods from sellers' participating stores to buyers. This means that unfortunately we do not facilitate orders for delivery to addresses beyond certain postcodes that the seller has indicated to us. For further information on where sellers on our marketplace are able to deliver, please enter a delivery postcode on the marketplace.
If you are not available to collect or accept delivery. The seller's delivery policy will apply to your order and shall set out what will happen if you are not available to collect or accept delivery. Unless otherwise advised by the seller, if you have selected to collect your order from a merchant, at the merchant’s discretion they will cancel your order if you have not collected at the agreed date and time, you may be charged a restocking fee.
What information do we need from you. We will need certain information from you to provide to the seller so that the seller can deliver your goods to you. This includes your delivery address, contact details, and proof of age where you are purchasing an age-restricted product or service. The seller’s delivery policy will apply to your order and they may require you to provide the delivery driver with proof of identity and/or age.
What will happen if you do not give required information to us. If you give the seller incomplete or incorrect information, the seller may be able to end the contract with you (in which case you could be charged a restocking fee by the seller) or the seller may make an additional charge of a reasonable sum to compensate it for any extra work that is required as a result (e.g. any re-delivery costs). We would advise you to consult the seller's terms for further details of the terms that shall apply in these circumstances.
Payment and refund terms
Where to find the prices for goods. The prices of goods, delivery costs (if applicable), and any service fees (if applicable) will be indicated on the order pages or app screens when you place your order. The price of goods and services on the Plane & Simple marketplace may differ from a seller’s in-store prices. We make reasonable efforts to ensure that the price of the goods and services advised to you are correct, however, the pricing of goods and services is solely the seller's responsibility.
What happens if the seller got the price wrong. It is always possible that, some of the goods listed on our platform may be incorrectly priced by the seller. However, if the goods correct price at your order date is higher than the price stated to you, the seller will contact you for your instructions before they process your order and may offer you a refund in accordance with the seller's terms and conditions.
How discounts work. Discounts may be offered on the online Plane & Simple marketplace from time to time. These discounts may be offered via discount codes, vouchers, special offers or coupons. Discounts offered by itsplaneandsimple.com are valid only for use as part of purchases made via itsplaneandsimple.com and may not be used in conjunction with any other offer. Discounts cannot be used for the purchase of gift cards. Only one discount code, voucher or coupon can be used per transaction and any discount code, voucher or coupon is valid for one transaction only. No cash alternative is available and discount codes, vouchers or coupons cannot be applied retrospectively. Discounts are at Plane & Simple’s sole discretion and may be withdrawn or cancelled by Plane & Simple at any time without notice.
Sellers will pass on changes in the rate of VAT. If the rate of VAT changes between your order date and the date of delivery of your goods, sellers will adjust the rate of VAT that you pay, unless you have already paid in full before the change in the rate of VAT takes effect.
When and how you must pay. As part of the facilitation service we provide to you via the online marketplace, we facilitate your payment to the seller for the goods. We accept payment by most debit and credit cards, and you must pay for the goods before they are despatched. Where your payment is not authorised, your order will not be processed.
How returns and refunds are handled. It is the responsibility of sellers on the Plane & Simple marketplace to respond and address requests for returns and refunds. Every seller on the Plane & Simple platform sets its own returns and refunds policy, links to returns and refunds policies will be available on the goods pages and in your order history in your Plane & Simple account.
We are a payment collection agent. Plane & Simple will act as an agent for the seller in respect of facilitating payments between the seller and buyer. We are authorised by sellers on our marketplace to accept payments for all buyer orders on their behalf and payment of the price of any goods and services to us will discharge your obligations to pay such price to the seller. As a payment collection agent, we are unable to issue VAT receipts, invoices or other documentation related the sale other than what is provided at the time of your purchase. To request a VAT receipt from a seller, please follow the steps noted in the FAQ section of our website.

If there is a problem with the goods or services you have ordered
The legal contract for your purchase is with the relevant seller. We have no responsibility for the seller and do not guarantee that any goods will be of satisfactory quality or suitable for your purpose. If there is a problem with the goods you have ordered, please contact the seller directly to lodge your complaint.
Our contract with you is in respect of your use of our online Plane & Simple marketplace, through which we facilitate your purchase of goods from sellers. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for fraud or fraudulent misrepresentation or for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors.

Our liability is limited
Our total liability to you in respect of all other losses shall be limited to the lower of the value of your order or £100.
Marketplace content. The content on our online marketplace is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our online marketplace. Although we make reasonable efforts to update the information on our online marketplace, we make no representations, warranties or guarantees, whether express or implied, that the content on our online marketplace is accurate, complete or up to date. Our online marketplace may also include information and materials uploaded by other users of the marketplace (such as other buyers and sellers), including for the purposes of providing reviews and feedback. This information and these materials have not been verified or approved by us. The views expressed by other users on our online marketplace do not represent our views or values. If you wish to complain about content uploaded by other users, please contact us via email to email@example.com.
Website links. Where our online marketplace contains links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them. We have no control over the contents of those sites or resources.
Viruses. We do not guarantee that our online marketplace will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform to access our online marketplace. You should use your own virus protection software. You must not misuse our online marketplace by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our online marketplace, the server on which our online marketplace is stored or any server, computer or database connected to our online marketplace. You must not attack our online marketplace via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our online marketplace will cease immediately.
Our rights to end the contract
We may end our contract with you in respect of your use of the marketplace and/or our provision of our order facilitation services at any time in accordance with these terms, including where:
- you do not make payment to the seller for the goods via our online marketplace;
- you do not provide us with information that is necessary for the seller to deliver the goods to you; or
- we are entitled to refuse to provide services to you in accordance with our regulatory requirements and ethical policy.
The seller should advise you of the circumstances under which they may end their contract with you in respect of the sale of the goods within their applicable terms and conditions.
We may suspend or withdraw our marketplace
Our online marketplace is generally made available free of charge. However, certain aspects of our services may incur a charge, if this is the case, we will notify you of any applicable charges prior to your purchase of goods from a seller.
We do not guarantee that our online marketplace or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our online marketplace for business and operational reasons.
How you may use material on our marketplace
We are the owner or the licensee of all intellectual property rights in our online marketplace, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
You may print off one copy, and may download extracts, of any page(s) from our online marketplace for your personal use and you may draw the attention of others within your organisation to content posted on our online marketplace.
You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
Our status (and that of any identified contributors) as the authors of content on our online marketplace must always be acknowledged.
You must not use any part of the content on our online marketplace for commercial purposes without obtaining a licence to do so from us or our licensors.
Feedback and rating
You may rate and leave feedback relating to sellers and goods using Plane & Simple’s rating and feedback system. You agree that all feedback may be publicly available in whole or part for viewing on the marketplace. We are under no obligation to verify or moderate any feedback provided (although we reserve the right to do so if we see fit), and shall not be liable for the content of feedback.
You must not submit any feedback which is defamatory, unethical or otherwise unlawful. You agree to indemnify and hold us and our employees, directors and representatives harmless against any claim or action brought by a third party, arising out of or in connection with any feedback left by you on the site.
Treatment of user content
Any content you upload to our online marketplace, including feedback and reviews will be considered non-confidential and non-proprietary. You retain all of your ownership rights in your content, but you are required to grant us and other users of our online marketplace, a limited licence to use, store and copy that content and to distribute and make it available to third parties.
When you upload or post content to our online marketplace, including feedback or reviews, you grant us the following rights to use that content: (i) a worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, distribute, prepare derivative works of, display, and perform that user-generated content in connection with the service provided by the online marketplace and across different media, including to promote the online marketplace or the service to expire when the user deletes the content from the online marketplace; and (ii) a worldwide, non-exclusive, royalty-free, transferable licence for other users of the online marketplace, including sellers to use the content in accordance with the functionality of the online marketplace to expire when the user deletes the content from the online marketplace.
We also have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to our online marketplace constitutes a violation of their intellectual property rights, or of their right to privacy.
You are solely responsible for securing and backing up your content. We do not store terrorist content.
How we may use your personal information
Other important terms
We may transfer this agreement to someone else. We may transfer our rights and obligations under these terms to another organisation. We will use reasonable endeavours to notify you of this, which may include posting a notice on our website.
You need our consent to transfer your rights to someone else. You may only transfer your rights or your obligations under these terms to another person if we agree to this in writing.
Territorial scope. Our marketplace is directed to people residing in the United Kingdom. We do not represent that content available on or through our online marketplace is appropriate for use or available in other locations.
Nobody else has any rights under this contract. This contract is between you and us. No other person shall have any rights to enforce any of its terms.
If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you but we continue to provide our services, we can still require you to make the payment at a later date.
This is our entire agreement with you. These terms make up the entire agreement between us in relation to the facilitation of your purchase of goods from sellers via our Plane & Simple online marketplace. You acknowledge that you have not relied on any other statements, promises or assurances made or given by or on our behalf which are not set out in these terms.
Which laws apply to this contract and where you may bring legal proceedings. These terms are governed by the laws of Scotland and you can bring legal proceedings in respect of the goods in the Scottish courts.
Plane & Simple WIN £500 Competition - Terms & Conditions - May 2, 2022
1. “WIN £500” prize competition will run across the Plane & Simple Website, Instagram, Facebook and Twitter social media channels.
2. To enter via the above social channels, participants must: Visit the ItsPlaneandSimple.com website and enter their Name and Email Address in the Pop-Up window. Participants can enter once per person.
3. One winner will be chosen at random.
4. This promotion is only open to UK residents with a UK address aged 18 and over, excluding employees of Plane & Simple, their family, and any other person directly connected with this promotion. You must reside within a postcode region we currently deliver to.
5. No purchase necessary.
6. Competition entry closes at 23:59 on 14/06/22. Entries after this date and time will not be considered.
7. The winner will be contacted via email by 15/06/22.
8. The winner will be notified via the email address they have used to enter the competition.
9. The prize is £500 to be spent on the Plane & Simple website. A member of P&S staff will be available to assist the winner in redeeming the prize. No cash or other alternative is offered in place of the prize named in these terms and conditions.
10. The prize needs to be accepted within seven days of the draw.
11. If the winner does not claim their prize within seven days of notification being sent, the Promoter reserves the right to re-draw and select a new winner (and so on until a winner can be contacted who will take up the prize).
12. The Promoter is not responsible or liable for any entries that are lost or delayed.
13. The prizes are non-transferable.
14. Sleeknote, Instagram, Facebook or Twitter do not in any way sponsor, endorse or administer this competition and are in no way associated with it. As such, by entering the competition, entrants release Sleeknote, Instagram, Facebook and Twitter from any liability to the entrant which arises from their entry to this competition.
15. By entering this prize draw, entrants agree to be bound by the Terms and Conditions governing this promotion and by any other requirements set out in related promotional materials.
16. The Promoter’s decision is final and binding in all matters and no correspondence will be entered into.
17. The Promoter reserves the right to vary the Terms and Conditions or cancel any or all competitions at any stage in the event of circumstances arising beyond its reasonable control.
18. Any question concerning the legal interpretation of the rules will be based on Scots law and the Scottish Courts will have exclusive jurisdiction.
